Local Zoning Innovations for Coastal Flood Resilience

Connecticut’s coastal communities face growing flood risks from sea level rise, higher tides, severe storms, and the concentration of homes and infrastructure along Long Island Sound. These risks are substantial: Connecticut’s 24 coastal municipalities account for approximately 80 percent of the state’s flood insurance policies and approximately 80 percent of its flood insurance losses since 1978.

WestCOG’s report, Local Zoning Innovations for Coastal Flood Resilience: Responding to a Changing Environment through Flexible Strategies, examines how coastal municipalities are using local zoning regulations to help property owners elevate, repair, relocate, or rebuild structures in flood-prone areas.

The report finds that Connecticut municipalities are already developing practical and locally tailored approaches to coastal resilience. These tools generally fall into four categories:

  • Flood elevation and freeboard standards above FEMA’s base flood elevation;
  • Flexible building-height standards;
  • Flexible setback standards; and
  • Community-wide alternatives to repeated, property-by-property variance applications.

Key Findings

Nineteen of Connecticut’s 24 coastal municipalities have adopted freeboard requirements above the minimum FEMA base flood elevation. Fourteen have adopted some form of flexible building-height regulation for flood-prone areas, and ten have adopted flexible setback provisions. These standards can help property owners elevate buildings, move structures to safer portions of a lot, accommodate exterior stairs and landings, repair septic systems, and undertake other flood-resilience improvements.

The report also finds that these tools are most effective when they are coordinated. A freeboard requirement may establish a safer elevation for a building, but the resulting structure may conflict with local height limits, setbacks, lot-coverage rules, or regulations governing nonconforming buildings. Flexible dimensional standards can reduce these conflicts and make flood adaptation more practical and predictable.

Moving Beyond Case-by-Case Variances

Zoning variances remain an important tool for addressing unusual hardship affecting an individual property. Coastal flood risk, however, frequently affects entire neighborhoods with similar exposure, small lots, existing nonconforming structures, and common dimensional constraints.

Where the same problem arises repeatedly, zoning text amendments, flood-resilience overlay zones, or other generally applicable standards may provide a clearer and more efficient alternative to requiring each property owner to seek individual relief.

These approaches do not eliminate zoning protections. Instead, they allow municipalities to establish predictable rules that support safer adaptation while continuing to protect neighborhood character, public safety, coastal resources, and neighboring properties.

Planning for Long-Term Coastal Change

Local zoning reforms are an important part of coastal resilience, but they cannot answer every long-term question. Decisions about protecting infrastructure, hardening neighborhoods in place, restoring natural systems, or considering long-term transition and retreat require coordination among municipalities, regional organizations, state agencies, and the federal government.

The report recommends that local zoning tools be incorporated into broader, multi-jurisdictional planning frameworks that consider flood exposure, infrastructure needs, environmental constraints, public and private costs, and the expected lifespan of buildings and public investments.

Public Act 25-33 provides an opportunity to advance this work by requiring municipal Plans of Conservation and Development to address sea level rise and climate resilience. The report encourages municipalities to connect these planning requirements with practical zoning reforms and credible flood-risk science.

Learning from Local Innovation

The report does not recommend a single statewide zoning model. Connecticut’s coastal communities differ in their development patterns, geography, infrastructure, environmental conditions, and tolerance for risk.

Instead, the report documents approaches already being used by Connecticut municipalities, identifies practices that may be transferable, and encourages communities to adapt those tools to local circumstances. The goal is to make flood-resilient improvements clearer, more predictable, and easier to implement before the next major storm.
